Florida Content Requirements Guide

This guide has been assembled to help you understand the requirements of the statutes of the State of Florida.

This guide reflects our best understanding of the act. It is not intended to serve as legal advice and is not guaranteed to be free of errors or omissions. We always recommend that you also consider the advice of your licensed community association manager (LCAM) and association council.

Let's determine your requirements...

The state of Florida has different requirements for different classifications of associations. Just because your community is a high-rise doesn't mean it is a condominium; and just because your community is a collection of freestanding houses doesn't mean it is a Homeowners Association (HOA).

You will find your chapter applicability in your governing documents, typically in the Articles of Incorporation. If you're unable to find this information, check with your association council or licensed community association manager (LCAM).

What's required

Florida Co-Ops governed under Statutes 719

The state of Florida does not require your association to have a website at this time.

HOWEVER, if you do, there are a few minimum requirements. These requirements show as "All" on the "Applies To" column below.

Retention requirements shown below apply only to your association website.
The Physical and Website retention requirements of association records differ, and are defined by your governing documents and Florida Statutes.

Management and Estoppel Certificate Contact Information

Text designating a person or entity with a street or e-mail address for receipt of a request for an Estoppel certificate.


From 719.108 (6); and 720.30851 in the act:

Each association shall designate on its website a person or entity with a street or e-mail address for receipt of a request for an Estoppel certificate issued pursuant to this section.

Estoppel Certificate Contact Information should be added to your Property Management Contact entry (found in the Property Management Contact control panel) in the Comments and Supplemental Content field.

This information accessed by clicking the "Contact Property Management" link on the home/login page, the "More Information" link inside the Property Management container of the Navigation Column, and within the Utilities & Local Links modules.

Notice and Agenda for UNIT OWNER meeting

From 719.106 (1) (c); and 720.303 (2) (c) 1. in the act:

...In addition to any of the authorized means of providing notice of a meeting of the board, the association may, by rule, adopt a procedure for conspicuously posting the meeting notice and the agenda on a website serving the condominium association for at least the minimum period of time for which a notice of a meeting is also required to be physically posted on the condominium property. Any rule adopted shall, in addition to other matters, include a requirement that the association send an electronic notice in the same manner as a notice for a meeting of the members, which must include a hyperlink to the website where the notice is posted, to unit owners whose e-mail addresses are included in the association's official records.

Many governing documents stipulate that Notices of Meetings and Agendas be posted in conspicuous locations. We have heard compelling arguments that websites are conspicuous locations, especially in our post-pandemic era where we host meetings virtually. To be safe, we recommend adding Notices of Meetings and Agendas to your website.

Tip: The notice and agenda document does not need to be retained on the website past the meeting date. We recommend retaining the document until the meeting minutes are available, or for up to one-year, whichever is less.

Meetings

Notices of Meetings and Agendas for associations with Digital Signage / Community Channel


From 719.106 (1) (c); in the act:

...In lieu of or in addition to the physical posting of the notice on the condominium property, the association may, by reasonable rule, adopt a procedure for conspicuously posting and repeatedly broadcasting the notice and the agenda on a closed-circuit cable television system serving the condominium association. However, if broadcast notice is used in lieu of a notice physically posted on condominium property, the notice and agenda must be broadcast at least four times every broadcast hour of each day that a posted notice is otherwise required under this section. If broadcast notice is provided, the notice and agenda must be broadcast in a manner and for a sufficient continuous length of time so as to allow an average reader to observe the notice and read and comprehend the entire content of the notice and the agenda...

If your association adopts a rule or procedure to post Notices of Meetings to your CondoSites Digital Information Display (digital signage) or integrated community channel, you will need to use the Newsboard Banner and/or a Newsboard Article to notice the date, time, and location of the meeting. If you use a Newsboard Article to notice your meeting and the agenda is too long to fit on the display carousel slide, you should refer viewers to the website for the information.

A calendar event should also be created for the event including the date, time, and location of the meeting, plus a link to the agenda document.

Tip: The notice and agenda document does not need to be retained on the website past the meeting date. We recommend retaining the document until the meeting minutes are available, or for up to one-year, whichever is less.
